Every person charged with a penal offence has the fundamental right to be treated with fairness and dignity. The first principle of any justice system is “Innocent until proven guilty.” This means no individual can be declared guilty without proper evidence, a fair hearing, and due legal process. Public trials, examination of evidence, access to a lawyer, and the opportunity to defend oneself are essential guarantees for justice.

According to the law, a person can only be punished for an act that was considered a penal offence under national or international law at the time it was committed. If a law changes after an incident, the person cannot be punished according to the new law. Similarly, no heavier penalty can be imposed than the one that was applicable at the time the offence occurred.

These protections exist to ensure that no citizen suffers injustice and that no authority can punish someone arbitrarily or unfairly. A just society is one where the law is equal for all and every person gets a fair and transparent trial.

This is why we must not only know our rights but also spread awareness so that society understands the importance of fairness, legality, and truth. Do not label any accused person as guilty unless proven so by a court of law. This is the core value of human rights and justice.

हर व्यक्ति जिसे किसी दंडनीय अपराध के लिए आरोपित किया जाता है, उसके साथ न्यायपूर्ण व्यवहार होना उसका मौलिक अधिकार है। किसी भी न्याय व्यवस्था का पहला सिद्धांत है— “जब तक अपराध सिद्ध न हो, आरोपी निर्दोष माना जाए।” इसका अर्थ है कि किसी भी व्यक्ति को बिना प्रमाण, बिना निष्पक्ष सुनवाई और बिना उचित प्रक्रिया के दोषी नहीं ठहराया जा सकता। सार्वजनिक सुनवाई, साक्ष्यों की जांच, वकील की सहायता और अपनी बात रखने का अवसर – ये सभी उसके बचाव के लिए आवश्यक अधिकार हैं।

कानून कहता है कि किसी व्यक्ति को केवल उसी कार्य के लिए दंडित किया जा सकता है, जो उस समय कानून के अनुसार अपराध था। यदि किसी घटना के बाद कानून बदलता है, तो व्यक्ति को उस बदलते कानून के अनुसार दंडित नहीं किया जा सकता। इसी तरह, अपराध के समय लागू दंड से अधिक कठोर दंड भी बाद में नहीं लगाया जा सकता।

यह व्यवस्था इसलिए बनाई गई है ताकि किसी भी नागरिक पर अन्याय न हो, और सत्ता या संस्थान किसी व्यक्ति को मनमाने ढंग से दंडित न कर सकें। एक न्यायपूर्ण समाज वही है जहाँ कानून सबके लिए समान हो, और हर व्यक्ति को निष्पक्ष सुनवाई मिल सके।

इसलिए हमें न केवल अपने अधिकारों की जानकारी रखनी चाहिए, बल्कि समाज में भी यह जागरूकता फैलानी चाहिए कि न्याय का आधार निष्पक्षता, सत्य और कानून का पालन है। किसी भी आरोपी को तब तक दोषी न मानें जब तक अदालत उसे अपराध साबित करके दोषी न ठहराए। यही मानवाधिकारों की मूल भावना है।
