Freedom of Movement and Assembly is a fundamental human right. It means that every person should have the liberty to travel freely within their country, gather peacefully, and express their views without fear.

India – Law vs. Reality
The Constitution of India (Article 19) guarantees citizens the right to move freely and to assemble peacefully. However, in practice, restrictions are often imposed — such as Section 144 to prevent gatherings, curfews, detentions of protestors, or limitations during political movements. Governments frequently justify these restrictions in the name of security and public order.

Situation in Surrounding Countries

• Pakistan & Bangladesh: The right is legally recognized, but protests are often met with police crackdowns, arrests, and violence.
• Nepal: Relatively more open, but restrictions are imposed during political instability.
• China: Very limited. Public demonstrations are tightly controlled, monitored, and often suppressed.
• Sri Lanka: During political and economic crises, governments have repeatedly restricted protests and gatherings.

Conclusion – Law vs. Reality
On paper, freedom of movement and assembly exists across the region. In reality, citizens often face barriers, surveillance, or outright suppression when they try to exercise it.

आवागमन और सभा की स्वतंत्रता (Freedom of Movement and Assembly) हर व्यक्ति का बुनियादी मानवाधिकार है। इसका अर्थ है कि कोई भी नागरिक स्वतंत्र रूप से अपने देश में यात्रा कर सके, शांति से इकट्ठा हो सके और अपनी राय व्यक्त कर सके।

भारतीय कानून और वास्तविकता
भारत के संविधान का अनुच्छेद 19 नागरिकों को आवागमन और शांतिपूर्ण सभा की स्वतंत्रता देता है। लेकिन वास्तविकता में कई बार इन अधिकारों पर प्रतिबंध लगाए जाते हैं—जैसे धारा 144 लगाकर भीड़ पर रोक, प्रदर्शनकारियों को हिरासत में लेना या आवाजाही पर कर्फ्यू जैसी पाबंदियाँ। सुरक्षा और सार्वजनिक व्यवस्था का हवाला देकर सरकारें अक्सर इस स्वतंत्रता को सीमित करती हैं।

आसपास के देशों की स्थिति

·         पाकिस्तान और बांग्लादेश: कानून में स्वतंत्रता की गारंटी है, लेकिन राजनीतिक प्रदर्शनों पर अक्सर पुलिस दमन, गिरफ्तारी और हिंसा देखी जाती है।

·         नेपाल: यहाँ अभिव्यक्ति और सभा की स्वतंत्रता अपेक्षाकृत अधिक सुरक्षित है, पर राजनीतिक तनाव के समय प्रतिबंध लगाए जाते हैं।

·         चीन: यहाँ नागरिकों के आवागमन और सभा की स्वतंत्रता बेहद सीमित है। किसी भी प्रकार के सार्वजनिक प्रदर्शन को कड़ी निगरानी और दमन का सामना करना पड़ता है।

·         श्रीलंका: आर्थिक और राजनीतिक संकट के दौरान विरोध प्रदर्शनों को रोकने के लिए सरकार ने बार-बार प्रतिबंध लगाए।

निष्कर्ष – कानून बनाम हकीकत
कानून में यह अधिकार सबको मिला है, लेकिन वास्तविकता में नागरिकों को अक्सर शांति से इकट्ठा होने या स्वतंत्र रूप से यात्रा करने में कठिनाइयों का सामना करना पड़ता है। सुरक्षा, राजनीति और सत्ता के दबाव में यह अधिकार कई बार अधूरा रह जाता है।

👉 इसलिए ज़रूरी है कि नागरिक और सरकारें मिलकर इस अधिकार की रक्षा करें, ताकि लोकतंत्र की आत्मा – स्वतंत्रता और भागीदारी – हमेशा जीवित रह सके।
